1. Agreement to Terms

By accessing or using Coherence, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2. Liability Disclaimer and Assumption of Risk

By using Coherence, you explicitly acknowledge, understand, and agree that:

• Breathwork exercises can be intense and may cause physical and emotional responses including but not limited to: lightheadedness, dizziness, tingling sensations, changes in heart rate, changes in blood pressure, altered states of consciousness, emotional release, anxiety, and in rare cases, loss of consciousness

• You are solely and fully responsible for your health, safety, and well-being while practicing breathwork, including but not limited to choosing an appropriate environment, position, and duration for practice

• You MUST consult with a qualified healthcare provider before starting any breathing practice, particularly if you have any pre-existing medical conditions, mental health conditions, or are pregnant

• You should NOT practice breathwork while operating machinery, vehicles, or in any situation where altered consciousness could pose a risk

• Coherence, its creators, owners, employees, contractors, affiliates, and partners (collectively "Coherence Parties") expressly disclaim ALL LIABILITY, whether based in contract, tort, negligence, strict liability or otherwise, for any direct, indirect, incidental, consequential, punitive, exemplary or special damages arising from or related to your use of the app

• You agree to HOLD HARMLESS AND INDEMNIFY the Coherence Parties against any claims, damages, costs, or expenses (including attorney fees) arising from your use of the app or violation of these terms

• You must immediately discontinue any practice that causes discomfort, adverse effects, or medical symptoms and seek appropriate medical attention

• This app is not a substitute for medical treatment, professional healthcare advice, mental health services, or emergency services

• The information and guidance provided in this app is for general informational purposes only and should not be considered medical advice

• You assume ALL RISKS associated with using this app and its breathing exercises, whether known or unknown, expected or unexpected

• Your use of this app constitutes your voluntary participation in breathwork activities and your explicit acceptance of all associated risks

3. Medical Disclaimer

The Coherence app does not provide medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or learned through this app. If you experience any medical emergency, immediately call your doctor or emergency services.

4. Subscription Terms

• Subscription will automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription by going to your Account Settings on the App Store
• Free trial automatically converts to a paid subscription unless canceled

5. Use License

Coherence grants you a limited, non-transferable, non-exclusive license to use the application for your personal, non-commercial purposes.

6. User Account

You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must immediately notify Coherence of any unauthorized use of your account.

7. Limitation of Liability

Coherence is provided "as is" without any warranty. We are not responsible for any damages arising from the use of our service.

8. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "Last updated" date.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Delaware for the resolution of any disputes.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
